General Rental Conditions

Each driver must present a valid driving license (category B license) valid for the country where the rental car will be used; the license must have been held for a minimum period established by law or local conditions; driving licenses in illegible characters must be accompanied by an international driving license.
The minimum age required for the rental is 25 years. If the Customer and/or driver is under 25 years old, they are aware that a different and higher deductible amount will be applied, as detailed in article 2.1 below.
Payment of the estimated rental amount and any charges resulting from damage or loss of the rented vehicle must be guaranteed at the time of rental.
The rental payment must be made with major financial credit cards, if accepted by the rental company, subject to authorization from the issuing institution.
A security deposit equal to the estimated rental and the deductible, as per article 2.2 below, is required; this may also be made by credit card payment, subject to payment authorization.

The Customer is required to take care of and use the vehicle with due diligence and, in particular, must not allow the vehicle to be used for subleasing activities, for transporting people or goods for commercial purposes against any kind of compensation or in cases prohibited by law, to push or tow vehicles, caravans, trailers, or anything else, for races, tests, or competitions, or if driven by the Customer or driver under the influence of alcohol, drugs, narcotics, barbiturates, or any other substance that may affect awareness, ability, or reaction time. The vehicle must not be used in violation of any customs, traffic, or other regulations. It must not be driven by a person other than the Customer unless such person has been indicated in the appropriate space at the time of filling out the rental contract. Additionally, the vehicle must not be driven outside Italian territory without prior written authorization from Different Srl.

The rented vehicle is covered by the following insurance policies included in the rental price and detailed in the rental agreement. RCA (Automobile Civil Liability) for damages caused to third parties; ARD (Various Auto Risks) covering fire, total or partial theft, natural and sociopolitical events, glass damage, and assistance.

2.1 Deductible in case of damage to the vehicle
The Customer, upon returning the vehicle, is responsible for any damage not previously indicated in the designated section of the rental contract at the time of vehicle delivery and signing. In case of damage to the rented vehicle, a fixed deductible will be charged as specified in the rental contract. If the damage was caused by the renter, they agree to pay the daily rental fee for the entire period during which the car cannot be used because it is being repaired.

2.2 Deductible in case of total fire or theft
In case of fire or total theft, which must be reported immediately (and in any case within 6 hours) to Different Srl, a fixed non-deductible deductible of 10% of the declared value will be charged, as specified in the rental contract.

2.3 Limitation of liability clause regarding the deductible
By signing the specific limitation of liability clause, indicated in a dedicated section of the rental contract, the Customer (provided they are over 25 years old) is exempt from paying the deductible (as per points 2.1 and 2.2), upon payment of the additional price indicated therein. In any case, the Customer must return the keys to the rental company within the time established for vehicle return and in any case within 24 hours from the discovery of theft or fire. Damage caused intentionally or due to carelessness and/or negligence by the Customer, damage to upholstery, the roof, damage resulting from refueling with fuel other than that specified for the rented vehicle, and repairs carried out directly by the Customer without Different Srl’s consent, as well as damage caused by driving the vehicle while it is faulty, are not covered by the limitation of liability.

If the vehicle is not available at the office or has already been booked by another Customer, the rental cannot be completed. The rates do not include fuel. Vehicles are normally delivered with a full tank of fuel. Any missing fuel at the time of return will be charged to the Customer, along with a refueling service fee of €30.00 for every quarter tank to be filled. Routine maintenance, oil, and lubricants are included in the rate. Any roadside assistance expenses must be expressly approved by Different Srl, and the request for assistance must be verifiable using the contacts provided in the rental contract. Such expenses will be reimbursed upon presentation of the original invoice.

By signing the rental agreement, the Customer acknowledges that the vehicle is in good working condition and free of apparent defects and agrees to return it to Different Srl in the same condition and by the date indicated in the rental contract. Different Srl reserves the right to terminate the contract and repossess the vehicle at any time if it is used in violation of the “Conditions of Use” set forth in these “General Conditions.”
The rented vehicle can be picked up and returned at one of Different Srl’s locations or at another place agreed upon in advance; normally, delivery and return must take place at the same location unless explicitly authorized by Different Srl. In cases where delivery and/or return occur at a different location, Different Srl may request a reimbursement.
The rental duration is counted in days, understood as periods of 24 hours, and the rate applied is calculated on 24-hour periods. The vehicle must be returned by the agreed time; if the delay exceeds 60 minutes, an additional rental day will be charged.
The rental option called “weekend” provides for pick-up on Friday afternoon and return by 10:00 AM on Monday, unless another time has been expressly agreed upon.
Failure to return the keys and registration document will result in the rental continuing until these items are fully returned or a written declaration of loss or theft is provided.
Loss or theft of any of these items will incur a penalty of €500.

The Customer and the driver are responsible for any traffic violations and are required to pay any fines, penalties, or sanctions issued to them (either through immediate contestation or subsequent notification, including to Different Srl) during the entire rental period. In case of non-payment, the Customer expressly authorizes Different Srl to charge the corresponding amounts to the credit card(s) provided in the rental agreement. The Customer agrees to send Different Srl any official notices received from public authorities within 48 hours. Failure to do so will make the Customer liable for any damages suffered by Different Srl, including indirect damages, due to the delay in transmission.
If requested by law enforcement, Different Srl is obliged to provide the name(s) of the driver(s) who will receive the fine notification for payment.

For payment, a credit or debit card is required at the time of booking depending on the car category and model.
If the rental is booked more than 30 days in advance, a reservation deposit equal to 25% of the total rental cost will be charged.
If the rental is booked between 30 and 15 days in advance, a reservation deposit equal to 50% of the total rental cost will be charged.
If the rental is booked less than 15 days in advance, a reservation deposit equal to 100% of the total rental cost will be charged.
The balance of the full amount will be requested 15 days before the rental start date. For bookings made within 15 days of the rental date, full payment is required at the time of booking.
The amount of the security deposit related to damage and theft coverage will be blocked on the customer’s credit card 5 days before the rental start date.
If it is not possible to block the deposit by the rental start date and time due to credit card issues not attributable to Different Srl, 100% of the booking fee will be charged.

The Client, at the time of the request, will pay or reimburse Different Srl the following amounts: the cost of the rental fee, always paid in advance, according to the rates in force or indicated in the rental contract; any charges for the fuel refilling service as per point 4; costs incurred due to late payment of amounts owed. The Client will be required to pay late payment interest at the current legal rate plus 3 percentage points; the Client will also be responsible for all legal, judicial, and extrajudicial expenses incurred by Different Srl for debt collection activities; any fines, penalties, administrative and legal expenses or those required by law arising from the use of the vehicle during the rental period, unless such are attributable to Different Srl; applicable taxes and duties in force during the rental period; all amounts not covered or reimbursed by the insurance company related to accidents caused by the Client or related to the theft of the rented vehicle; all amounts provided for in this contract even if not explicitly listed here. The Client expressly authorizes Different Srl to charge all related amounts to the credit card(s) indicated in the rental contract, even if such amounts become due or payable after the vehicle is returned. In no case shall the Client who has acted illegally be relieved of direct responsibility toward any authority.

Any accident must be reported immediately and in any case no later than six hours to Different Srl. An accident report (i.e., the Friendly Accident Report - C.I.D) must be completed whenever requested and always at the time of vehicle return. The Client agrees to obtain information about witnesses and the vehicles involved. The Client also agrees to cooperate with Different Srl in any investigation or criminal proceedings.
